The purposes of a National Firearms Act Trust (referred to as a “gun trust”) can vary but often are focused on staying compliance with federal, state, and local laws that apply to certain firearms while also allowing a smooth transfer of these items upon the death of an individual. A gun trust also allows the transfer of firearms without going through the probate process and having these transfers become part of the public record.
Finally, a gun trust is also useful for incapacity planning. As the owner of the guns, if you become incapacitated the possession, sale, or even movement of a firearm could violate state and federal law. A gun trust would alleviate these concerns and nominate a individual(s) to properly handle your firearms in the event you are no longer able to do so.
